What Is RERA and Why Was It Introduced?

The RERA Act was introduced by the Government of India to bring order, transparency, and accountability to this sector  and to shift the balance of power back towards the buyer. The Kerala Real Estate Regulatory Authority, K-RERA, was subsequently established to implement these standards at the state level, with its online portal going live in 2020.

Before registering under RERA, a developer must submit a comprehensive set of project details to the authority — including land ownership documents, approved building plans, No Objection Certificates (NOCs), and a clearly defined project completion schedule. All of this becomes part of the public record and serves as legal documentation in the event of any future dispute.

A developer cannot advertise or begin selling a project before obtaining RERA registration. Once registered, all promotional material must accurately reflect the details submitted to the authority. There is no room for inflated claims or vague promises.

Under RERA, the carpet area the actual usable floor space within your property is the standardised basis for pricing. Earlier, ambiguous methods of calculating saleable area often left buyers paying for space they could not actually use. That ambiguity has been removed.

Under K-RERA regulations, 70% of all funds collected from buyers must be deposited into a dedicated escrow account and used exclusively for the registered project. This prevents the misuse of buyer funds and ensures the project can be completed as planned. Project audits are also conducted every six months by certified chartered accountants and engineering surveyors.

If a project is delayed beyond the agreed timeline, the developer is liable to pay interest on the amounts collected from buyers. You also have the right to withdraw from the project entirely and claim a full refund, or choose to stay and receive compensation for the period of delay.

No alterations can be made to the approved plans or specifications of a project without the consent of at least two-thirds of the registered buyers. This gives you a meaningful say in how the project is executed.

For five years from the date of possession, the developer is responsible for rectifying any structural defects at no additional cost to the buyer. Should the developer fail to act within 30 days of being notified, you are entitled to raise a formal complaint with the authority.
